The research examines the complex issues relating to the presume acknowledgement of the notion of direct representation in the Justinian law. The author excludes that the Justinian jurists have advanced the solutions of the problems inherited from a secular and complex tradition trough a dogmatic recostruction of the representation in which we can find the conceptual bases of the modern elaboration of our institute.
