This contribution presents some structurally limiting aspects of generative AI. It proceeds from the distinction between “expert systems” and “generative systems”, and defines the specific features of human reasoning. Law is used as a paradigmatic reference as much to demonstrate the productivity and, at the same time, problematic nature of the concrete use of AI as in favour of theoretical-speculative research interested in interpretative processes and the complexity of the human. A new exercise of rapprochement between formalism and hermeneutics appears strategic for a use of generative AI that respects the complexity and uniqueness of the human.
