Il contrasto alla criminalità transnazionale nell’Unione Europea. Atti di indagine e regime di acquisizione probatoria.

The present thesis is about the judicial cooperation in criminal matters. The work start from the beginning of the cooperation and the development of a various forms of cooperation, especially at the EU level. After that, the thesis is aimed to analyze different kinds of specific instruments of judicial cooperation in prevention and fight to the transnational criminality, in particular in the moment of the research and acquisition of evidences. The thesis is based on the comparative methodology, in particular of the Italian and the Spanish law system, analyzing especially the different steps of a criminal procedure, so that, first, the investigations and then the judgment in front of a court. The last part of the work, is focused on a particular kind of transnational crime which is the most important in the present century: the terrorism, which is studied at a EU level, considering that only at that level, is possible to identify the instrument to fight a so huge threat.
