Aborto in Italia. Problematiche e prospettive

The thesis is divided into five chapters that try to touch all the various aspects of abortion according to the multidisciplinary approach of the PhD in Legal Sciences. The first part deals with the ethical issue related to abortion: it analyzes why, over the years, it was and is so difficult to regulate abortion. The second part deals with the history of abortion in the Italian regions, from the Greco-Roman age to today. The third part concerns the analysis of the main rights involved in Law 194/78. The fourth, the most important, concerns the discipline of abortion in Italy, it examine if a real right to abortion exists, and identifies the implementation issues of the law, the critical issues and the solutions currently identified by doctrine and jurisprudence. Following is the fifth part, with a comparative approach, whose aim is to examine the discipline of Spain and Belgium, where the problems found in Italy do not exist, in order to draw ideas for improving the Italian discipline. Finally, the conclusions are structured as a proposal to amend Law 194/78.
