One of the main objectives of the European Union is the creation of a single market, and the liberalization of the air services market is one of the best results that could be achieved. The same trend has developed at international level and, however, has exacerbated the competitiveness between air carriers, especially non-European carriers, for transportation to and from Europe. The non-European air carriers have managed to gain increasing market shares, also through the use of unfair and discriminatory practices, represented by State subsidization and unfair pricing – against European air carriers. In order to contrast the phenomenon, the then European Community intervened with Regulation (EC) No. 868/2004, soon deemed to be inadequate by the same Commission so that on 8 June 2017 a proposal of a new regulation was published, which, nevertheless, has raised criticism and concerns even before its final approval.
Uno dei principali obiettivi dell’Unione europea consiste nella creazione di un mercato unico e la liberalizzazione del mercato dei servizi aerei comunitari costituisce uno dei risultati migliori che si potessero conseguire. La medesima tendenza sviluppatasi a livello internazionale ha, tuttavia, esacerbato la competitività tra compagnie aeree – specie extraeuropee in relazione ai trasporti da e verso l’Europa – le quali sono riuscite a guadagnare crescenti quote di mercato anche attraverso il ricorso a pratiche scorrette e discriminatorie – rappresentate dagli aiuti di Stato e dalla tariffazione sleale – ai danni di vettori comunitari. Per cercare di contrastare il fenomeno, l’Unione europea è intervenuta con il reg. Ce n. 868/2004, ben presto avvertito come inadeguato dalla stessa Commissione, tanto che l’8 giugno 2017 è stata presentata una proposta di nuovo regolamento che, nondimeno, suscita critiche e preoccupazioni prima ancora della sua definitiva approvazione.
