The work examines the discipline of cohabitee collaboration in the enterprise of the partner, introduced by art. 230-ter c.c., in comparison with art. 230-bis c.c., highlighting the interpretation problems and the systemic implications, in the perspective of their possible consequences on the enterprise. The extra-family frame in which art. 230-ter is placed, the content of rights recognized and the coordination problems with the discipline of family enterprise create uncertainties on the constitutional legitimacy level and cause few doubts of an inadequacy protection of work performed in the enterprise in absence of marriage bond.
