A sea traffic management system allows ships engaged in international trade to share and process information on their route, rotation, speed etc, and adjust her trade in order to facilitate port and port infrastructure efficiency. A new clause from BIMCO allows the charterer to ask the owner to adjust the speed of the ship, when reasonable, to meet the arrival time which the system indicates as the most appropriate. The clause allows for a test of reasonableness which prompts the parties to environmental factors as well as more traditional business considerations. This environmental reasonability element in the compliance of charterer’s orders amounts to a significant development in the field.
