La Corte ritorna, ancora una volta, a ribadire un concetto che emerge molto chiaramente dal dato normativo ma che ha destato spesso problemi interpretativi nella giurisprudenza di merito: la necessità che il provvedimento cautelare posto a base del mandato di arresto europeo provenga da un giudice.
