Dinamicità del rapporto di filiazione e mantenimento del figlio maggiorenne tra gradualità della prova e crisi della fattispecie

The essay analyzes the problem of the right to maintenance of an adult child with particular regard to its duration and to the allocation of the burden of proof concerning its persistence. The survey highlights the reciprocity and dynamism as key features of the relationship between parent and child, as well as the importance of the principle of self-responsibility in determining the respective rights and duties of the parties involved. In particular, as far as the burden of proof is concerned, the dynamic character of the relationship is reflected in the different solutions found by the Courts based on the general principles and on the very specific circumstances of the case. This approach confirms the fall, or crisis, of the different technique of evaluation, based on the more static and abstract consideration of the case, the so called — in the Italian literature — theory or methodology of the “fattispecie”.

Il contributo analizza il problema del diritto al mantenimento del figlio maggiorenne con particolare riferimento alla sua durata e alla ripartizione dell’onere della prova della sua persistenza. L’indagine evidenzia la reciprocità e dinamicità del rapporto tra genitore e figlio e la rilevanza del principio di autoresponsabilità nella determinazione dei rispettivi diritti e doveri. La rilevata dinamicità del rapporto si riflette sul piano probatorio giustificando le differenti soluzioni giurisprudenziali, che trovano fondamento non tanto nella tecnica della fattispecie, che rivela ancora una volta la sua crisi, ma nei principi generali e nella valutazione delle circostanze concrete.
