Comparing the seven leges damnatae identified by van Eck and the traditional catalogue (perhaps of medieval origin) of leges damnatae, the essay highlights van Eck’s tendency to privilege matters of immediate practical impact: in this sense the attention paid to the associative agreement for supplying food markets is highlighted. In the Dutch list, the role of the creditum is especially important: five out of seven leges concern the mortgage, the amortisation of capital and interest in constant instalments, the place of payment, the regime of the guarantee, and interest. The attention to philology, and therefore to the text of the Corpus iuris seen as a problem in itself; the combination of ratio legis and the search for the system; the recourse to Cartesian logic under Spinoza’s influence of the application to the humanities of the method proper to the mathematical and natural sciences are the framework that allows us to understand the cultural and practical significance of van Eck’s doctoral thesis.

Ausgehend von einem Vergleich der sieben von van Eck identifizierten leges damnatae mit dem traditionellen Katalog (vielleicht mittelalterlichen Ursprungs) der leges damnatae hebt der Aufsatz die Tendenz van Ecks hervor, Angelegenheiten mit unmittelbarer praktischer Auswirkung zu bevorzugen: in diesem Sinne wird die Aufmerksamkeit hervorgehoben, die dem assoziativen Vertrag zur Versorgung der Lebensmittelmärkte gewidmet wird. In der niederländischen Liste ist die Rolle des creditum besonders wichtig: fünf der sieben leges betreffen die Hypothek, die Tilgung von Kapital und Zinsen in konstanten Raten, den Zahlungsort, die Regelung der Bürgschaft und die Zinsen. Die Aufmerksamkeit für die Philologie und damit für den Text des Corpus iuris, der als Problem an sich betrachtet wird, die Verbindung von ratio legis und der Suche nach dem System, der Rückgriff auf die kartesische Logik unter dem Einfluss von Spinoza und die Anwendung der den mathematischen und natürlichen Wissenschaften eigenen Methode auf die Geisteswissenschaften bilden den Rahmen, der es uns ermöglicht, die kulturelle und praktische Bedeutung von van Ecks Doktorarbeit zu verstehen.
