A recent focus on the «assunzione del debito altrui» suggests a tendential consonance between the receptum argentarii and the current Italian legal institution of «espromissione»: nevertheless, the receptum was a figure of bank guarantee not involving novatio, so that the roots of the legal institutions that, in the contemporary Italian legal system, govern the «assunzione del debito altrui» must rather be sought in the use of stipulatio involving novatio.

Abstract
