The essay addresses the issue of the distribution of competences between state legislative power and regional legislative power and between law and collective bargaining on the regulation of in-company training which characterizes the professionalizing apprenticeship contract, taking inspiration from the ruling of 24 May 2010, n. 176 of the Constitutional Court, which redesigned the art. 49, paragraph 5-ter, of the Legislative Decree. lgs. 10 September 2003, n. 276 (introduced by art. 23, 2nd paragraph, of the Legislative Decree of 25 June 2008, converted by law 6 August 2008, n. 133), because it is partially unconstitutional with respect to the articles. 117 and 120 of the Constitution. The aim is to establish the space for intervention of regional legislation (art. 117, 4th paragraph, Constitution) and that of collective autonomy and bilateral bodies, provided for by ordinary law (art. 49, paragraph 5-ter, Legislative Decree no. 276 of 2003), following the correction made by the constitutional judges.
Il saggio affronta la questione della ripartizione delle competenze tra potere legislativo statale e potere legislativo regionale e tra legge e contrattazione collettiva sulla disciplina della formazione endoaziendale che caratterizza il contratto di apprendistato professionalizzante, prendendo spunto dalla sentenza 24 maggio 2010, n. 176 della Corte Costituzionale, che ha ridisegnato l'art. 49, comma 5-ter, del d. lgs. 10 settembre 2003, n. 276 (introdotto dall'art. 23, 2° comma, del D.L. 25 giugno 2008, convertito dalla legge 6 agosto 2008, n. 133), perché parzialmente incostituzionale rispetto agli artt. 117 e 120 Cost. Lo scopo è stabilire quale sia lo spazio di intervento della legislazione regionale (art. 117, 4° comma, Cost.) e quello dell'autonomia collettiva e degli enti bilaterali, previsto dalla legge ordinaria (art. 49, comma 5-ter, d. lgs. n. 276 del 2003), a seguito della correzione operata dai giudici costituzionali.
