On the possibility of protecting abortion through the right of the European Union: reflections on the Polish case = Sulla possibilità di tutelare l’aborto attraverso il diritto dell’Unione europea: riflessioni a partire dal caso polacco

The essay analyses whether and if it is possible for the European Union to protect the abortion. Starting from the ban on abortion in Poland, the reaction of EU will be examined. Due to the fact that abortion does not fall within the competence of the Union, any guarantee must involve the protection of human rights as funda-mental values of the EU; it is therefore necessary to establish whether abortion can be classified as a human right under international law. A reflection follows on the ways European law offers to preserve abortion and whether the introduction of art. 7bis in EU Charter could enforce the protection of legal and safe abortion in all mem-ber States

Il saggio analizza se e come l’Unione europea possa tutelare il diritto all’aborto. Partendo dal caso polacco, verifica come le istituzioni europee siano inter-venute. Considerato che l’aborto non rientra nelle competenze dell’Unione, ogni ga-ranzia passa attraverso la tutela dei diritti umani come valori fondanti l’UE. L’autrice si domanda pertanto se ed entro quali limiti l’aborto possa qualificarsi come diritto umano nel diritto internazionale. Segue una riflessione volta ad individuare i mezzi che il diritto europeo offre per tutelare l’interruzione di gravidanza e a verificare se l’introduzione dell’art. 7 bis nella CDFUE potrebbe garantire l’aborto sicuro e legale negli Stati membri.
