Appunti sui soggetti nel contratto di deposito

The paper aims to analyze the subjective outlines of the deposit contract. Starting from an analysis of the competence and legitimacy requirements of the parties, the study develops by addressing the issues – still open – arising from the presence of one or both subjectively complex parties and then focuses on the matters deriving from the involvement of third parties in the contract.

Il saggio è dedicato ai profili soggettivi del contratto di deposito. Partendo da un’analisi sui requisiti di capacità e legittimazione dei contraenti, l’indagine si sviluppa affrontando le questioni – ancora aperte – nascenti dalla presenza di una o entrambe le parti soggettivamente complesse per poi incentrarsi sulle problematiche derivanti dal coinvolgimento di soggetti terzi nel regolamento negoziale.
