The article analyses the position of the CJUE in front of the neutrality policy adopted by a private company in a sentence of July 15, 2021. The importance of this sentence is the existence of two Opinions contradictory, one in 2019 of the first Advocate General, Eleanor Sharpston, who was however delayed and was reallocated to her successor Advocate General Athanasions Rantos on 10 Septembre 2020
