The essay first analyzes the various interpretative questions left open by the Constitutional Court sentence no. 242 of 2019, through a declaration of unconstitutionality constructed in a singular way, with references to the subject, a person suffering from terminal illness, a source of suffering deemed intolerable by the same and who is kept alive by means of vital support treatments but who nevertheless remains capable of making free and informed decisions. The analysis then focuses on euthanasia practices and questions, in particular, whether the arguments put forward in support of the unlawful killing of the consenting person and of assisting suicide are well founded. Finally, one wonders if the legalization of euthanasia is in accordance with the Constitution and if, therefore, it is legitimate for our legal system.
