Spunti di riflessione su motivi aggiunti ed oneri d'impugnazione alla luce del principio di effettività della tutela

The paper is based on the idea that, at present, not all the critical profiles of the institute have been clarified. Therefore, on the basis of the pertinent 'positive' data and the related excursus of jurisprudence, an attempt has been made to leverage the profiles of more peaceful sharing in order to better elucidate those that seem most in the shadows: especially with regard to the related burdens and the implications in the light of the principle of effectiveness of protection.

Lo scritto muove dall’idea che, allo stato attuale, non tutti i profili di criticità dell’istituto sono stati chiariti. Pertanto, sulla scorta del pertinente dato ‘positivo’ e del correlato excursus di giurisprudenza, si è tentato di far leva sui profili di più pacifica condivisione onde meglio elucidare quelli che paiono maggiormente in ombra: specie quanto agli oneri connessi ed alle implicazioni alla luce del principio di effettività della tutela.
