Autonomous vehicles and civil liability: a functional, intentional, and cybernetic perspective The swift technological progress in the field of automotive challenges jurists with new issues, such as those raised by automated driving vehicles. This paper is intended to shed light on the civil liability for damages caused by using such vehicles: specific attention is paid, firstly, to the observation of the technical and empirical plan, which is essential to appreciate its peculiarity compared to the cases that are already well known. The phenomenon is then legally qualified, in relation to both systematic and practical profiles. It is shown, therefore, how complex computer systems make necessary a change of paradigm in the legal analysis of their functioning, via the transition from an instrumental-causal conception to a functional, intentional, and cybernetic perspective.
Il rapido progresso tecnologico nel campo dell’automotive pone il giurista di fronte a problematiche inedite, quali quelle sollevate dai veicoli a guida automatizzata. Con il presente contributo si intende fare luce sulla responsabilità civile per i danni cagionati dalla circolazione di tali veicoli: un’attenzione specifica viene dedicata, in primo luogo, all’osservazione del piano tecnico ed empirico, indispensabile al fine di apprezzarne la peculiarità rispetto alle fattispecie già note. A seguire, si procede a qualificare giuridicamente il fenomeno, con riguardo sia ai profili sistematici che a quelli applicativi. Si evidenzia, dunque, come i sistemi informatici complessi rendano necessario un cambio di paradigma nello studio giuridico del loro funzionamento, col passaggio da una concezione di tipo strumentale-causalista a una prospettiva funzionale, intenzionale e cibernetica.
