The paper analyzes the ruling in which the Constitutional Court declared the illegitimacy of the law that prevents single people from internationally adopting. In line with the approach aimed at prioritizing the best interest of the child, the Court broadens the circle of potential adoptive parents by comprising unmarried individuals through a balancing of the involved interests, including the right to parenthood. The commentary on the ruling highlights the inadequacy of the current legislation, still tied to the criterion of imitatio naturae and a dual-parenting model based on marriage, in light of the legal recognition of new family models. These latter models, in particular, have led to an evolution in the concept of parenthood, which is no longer inextricably linked to biological origin but also relies on consent and the assumption of responsibility for the birth. The analysis of the legal framework, also in light of social demands, leads the author to propose a reform aimed at eliminating the rigidities that characterize adoption regulations, allowing the judge to provide a solution based on the concrete needs of the child, without preconceived exclusions based on applicants’ condition. This would permit (not only international) adoption by singles, as well as by de facto or same-sex couples.
Il contributo analizza la sentenza con la quale la Corte costituzionale ha dichiarato l’illegittimità della norma che preclude l’adozione internazionale da parte di persone single. La Corte, in linea con l’orientamento volto a valorizzare il best interest of the child, amplia la platea dei potenziali adottanti includendo le persone non coniugate attraverso un bilanciamento degli interessi coinvolti, tra i quali comprende anche quello alla genitorialità. Il commento alla sentenza evidenzia l’inadeguatezza della disciplina in vigore, ancora legata al criterio dell’imitatio naturae e ad un modello bigenitoriale fondato sul matrimonio, a fronte del riconoscimento anche normativo di nuovi modelli familiari. Questi ultimi, in particolare, hanno determinato una evoluzione del concetto di genitorialità, la cui costituzione non è più indissolubilmente legata alla derivazione biologica ma si fonda anche sul consenso e sull’assunzione della responsabilità per la nascita. L’analisi del quadro normativo, anche alla luce delle istanze sociali, porta l’Autrice a prospettare una riforma volta ad eliminare le rigidità che caratterizzano la disciplina dell’adozione, per consentire al giudice una soluzione improntata sui concreti bisogni del minore, senza aprioristiche preclusioni fondate sulla condizione dei richiedenti, così da potersi ammettere l’adozione (non solo internazionale) da parte di single, ma anche di coppie di fatto o dello stesso sesso.
