L’apprendistato nel pubblico impiego secondo il 'Decreto Rafforzamento della Capacità Amministrativa'

In this article, the author addresses apprenticeships in the public sector as regulated by art. 3-ter, paragraph 1, of Legislative Decree no. 44 of 22 April 2023 (the “Administrative Capacity Strengthening Decree”), as part of the second pilot program, which anticipates the implementation of art. 47, paragraph 6, of Legislative Decree no. 81 of 15 June 2015. In particular, the author compares the situation under examination with that contemplated, within the framework of the first pilot program, by Legislative Decree no. 80 of 9 June 2021, as well as with professionalizing apprenticeships (art. 43, Legislative Decree no. 81/2015) and with advanced research training apprenticeships (art. 44, Legislative Decree no. 81/2015).

Nel presente contributo l’Autrice si occupa dell’apprendistato nel pubblico impiego così come disciplinato dall’art. 3-ter, co. 1, del D.L. 22 aprile 2023, n. 44 (c.d. “Decreto Rafforzamento della Capacità Amministrativa”), nell’ambito della seconda sperimentazione, che anticipa la messa a regime dell’art. 47, co. 6, del D.Lgs. 15 giugno 2015, n. 81. In particolare, effettua una comparazione della fattispecie in esame sia con quella contemplata, nel quadro della prima sperimentazione, dal D.L. 9 giugno 2021, n. 80 che con l’apprendistato professionalizzante (art. 43, D.Lgs. n. 81/2015) e con quello di alta formazione e ricerca (art. 44, D.Lgs. n. 81/2015).
