After outlining the peculiar hierarchy of sources established by Article 1496 of the Italian Civil Code and its relationship with the Consumer Code, the paper addresses the issues of warranty for defects, lack of qual- ity, and non-conformity in the sale of animals. The analysis then focuses on determining whether a prohibition on the commercialisation of animals af- fected by infectious and contagious diseases exists, examining this aspect in light of Regulation (EU) 2016/429 (also known as the Animal Health Law – AHL).
Dopo aver delineato la peculiare gerarchia delle fonti stabilita dall’art. 1496 c.c. e il relativo rapporto con il codice del consumo, il contributo af- fronta i temi della garanzia per vizi, della mancanza di qualità e della diver- sità della cosa nella vendita di animali. L’analisi si concentra poi sull’accer- tamento della sussistenza di un divieto di commerciabilità degli animali af- fetti da malattie infettive e contagiose, inquadrando tale profilo alla luce del Regolamento (UE) 2016/429 (noto anche come Animal Health Law– AHL).
