D. 19.5.5.3 regarding the protection afforded to those who have performed a facere to bind the other party to a dare, which, however, is not carried out, namely the actio praescriptis verbis for Ulpian and the actio de dolo for Paul, may be evidence of a hidden controversy between Ulpian and Paul.
