Both incidents led to legislative and administrative interventions aimed at protecting dignity and public order, yet they limited the professional choices of the individuals involved. While these measures are intended to safeguard vulnerable people, they risk producing indirect discrimination, paradoxically restricting inclusion and autonomy. The analysis underscores the need for a balanced legal and ethical approach that respects both personal dignity and the right to freely pursue professional activities, avoiding normative paternalism that undermines individual self-determination. The paper calls for nuanced policies that reconcile protection with autonomy, ensuring that safeguarding vulnerable groups does not inadvertently constrain their freedoms.
Il presente contributo esplora la tensione tra dignità umana e libertà di lavoro per le persone con nanismo, concentrandosi sui casi francesi del ‘lancio del nano’ e comico taurino spagnolo. Entrambi gli eventi hanno portato a interventi legislativi e amministrativi volti a proteggere la dignità e l’ordine pubblico, ma hanno limitato le scelte professionali degli individui coinvolti. Sebbene tali misure mirassero a tutelare persone vulnerabili, rischiano di produrre discriminazione indiretta, restringendo paradossalmente inclusione e autonomia. L’analisi evidenzia la necessità di un approccio giuridico ed etico equilibrato, che rispetti sia la dignità personale sia il diritto di perseguire liberamente attività professionali, evitando un paternalismo normativo che comprometta l’autodeterminazione. Il lavoro sollecita politiche attente che concilino protezione e autonomia, assicurando che la tutela dei gruppi vulnerabili non limiti involontariamente le loro libertà.
