This article analyzes the concept of intra-family damages, which has been the sub-ject of heated scholarly and judicial debate in relatively recent times. This phe-nomenon - which stems from the need to adapt legal rules to changes in society - brings together two major branches of civil law: family law and tort law, which for a long time were regarded as autonomous and unrelated systems. Following a brief historical and legal overview of the reasons underlying the family’s immunity from liability for damages resulting from wrongful conduct by one family member to-ward another, the paper analyzes the various factors that have contributed to the correlation between family and liability, with particular reference to different fam-ily models.
Il contributo analizza l’istituto del danno endofamiliare oggetto di accesi di-battiti dottrinali e giurisprudenziali in tempi relativamente recenti. Il fenomeno – che nasce dalla necessità di adeguare la regola precettiva ai cambiamenti della so-cietà – unisce due grandi branche del diritto civile, quella della famiglia e quella dell’illecito, considerate per lungo tempo come sistemi autonomi e non comuni-canti. Dopo una breve excursus storico-giuridico sulle ragioni che hanno fondato l’immunità familiare dal risarcimento del danno per condotte illecite realizzate da un componente della famiglia verso altro componente dello stesso nucleo, si ana-lizzano i vari fattori che hanno contribuito alla correlazione del binomio famiglia-responsabilità con particolare rifermento ai diversi modelli familiari.
