The fact that a debtor’s performance of a civil obligation constitutes a mandatory act explains why it is excluded from the scope of revocatory actions. The situation becomes more complex, however, when performance is effected through “abnormal” means. It is argued, for instance, that datio in solutum (performance by giving something other than what was originally owed) is subject to revocation, as it entails an element of discretion. The same should apply to novation and voluntary set-off, both of which are subject to revocatory action.

Abstract

The fact that a debtor’s performance of a civil obligation constitutes a mandatory act explains why it is excluded from the scope of revocatory actions. The situation becomes more complex, however, when performance is effected through “abnormal” means. It is argued, for instance, that datio in solutum (performance by giving something other than what was originally owed) is subject to revocation, as it entails an element of discretion. The same should apply to novation and voluntary set-off, both of which are subject to revocatory action.
